New York City Pharmacy is staffed at all times during operating hours by a pharmacist licensed by the New York State Board of Pharmacy, and operates under the direct supervision of a designated Pharmacist-in-Charge as required under 8 NYCRR § 63.6 and New York Education Law § 6808. 3. Scope of Services and Jurisdictional Limits
New York City Pharmacy provides two distinct categories of services through this website and our physical pharmacy location:
(a) Licensed Pharmacy Services (New York only): Dispensing of prescription medications, pharmacist counseling, medication therapy review, wellness consultations, immunizations (where authorized), and DMV vision screening, each conducted within the scope of pharmacy practice authorized under New York Education Law Article 137 and 8 NYCRR Part 63, and subject to the regulations of the New York State Board of Pharmacy. Prescription medications are dispensed only pursuant to a valid prescription from a licensed prescriber and are delivered only within a limited local radius of our New York pharmacy location, exclusively by our own in-house delivery personnel. We do not ship prescription medications across state lines.
(b) Non-Prescription Retail Products (U.S. nationwide): Over-the-counter medications, vitamins and dietary supplements, health and wellness products, beauty and personal care products, pet products, and other general retail merchandise. Non-prescription products may be shipped to customers in all 50 U.S. states.

4. Telehealth Programs — Independent Providers
Certain telehealth programs are marketed through landing pages linked from nycprx.com, including programs operated by OpenLoop Healthcare Partners, PC and/or Agile Telehealth (the "Telehealth Providers"). These telehealth programs are not operated, staffed, or prescribed for by New York City Pharmacy, and any prescription medications prescribed through those programs are not dispensed by New York City Pharmacy. Clinical consultations, prescribing decisions, laboratory ordering, and pharmacy dispensing for those programs are performed independently by the Telehealth Providers and their affiliated licensed clinicians and pharmacies. New York City Pharmacy's role with respect to such programs is limited to non-clinical marketing and patient education support.
Your use of any telehealth program marketed on this website is governed by the Telehealth Provider's own terms of service, privacy policy, and clinical agreements. Questions, complaints, refund requests, or clinical concerns relating to a telehealth program should be directed to the applicable Telehealth Provider.
5. Medical, Pharmacy, and Nutritional Disclaimers
5.1 Not Medical Advice
Information presented on this website about medications, medical conditions, wellness, nutrition, dietary supplements, lifestyle, or related topics is provided for general educational purposes only and is not medical advice. It is not intended to diagnose, treat, cure, or prevent any disease, and is not a substitute for consultation with a physician, nurse practitioner, or other qualified healthcare provider. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or medication.
5.2 Pharmacist Counseling
Pharmacist counseling, wellness consultations, and medication therapy review services offered by New York City Pharmacy do not constitute the practice of medicine. Our pharmacists do not diagnose disease, independently order laboratory tests, or initiate or modify prescription therapy except pursuant to a valid Collaborative Drug Therapy Management (CDTM) agreement authorized under New York Education Law § 6801-a.
5.3 Dietary Supplements (DSHEA)
Dietary supplements sold through New York City Pharmacy are regulated by the U.S. Food and Drug Administration as food products under the Dietary Supplement Health and Education Act of 1994 (DSHEA), and are not drugs.
These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.
Consult with a qualified healthcare provider before starting any dietary supplement, particularly if you are pregnant, nursing, have a medical condition, or are taking prescription medications.
5.4 Controlled Substances
The dispensing of controlled substances by New York City Pharmacy is subject to the federal Controlled Substances Act (21 U.S.C. § 801 et seq.), the New York State Controlled Substances Act (Public Health Law Article 33), regulations of the U.S. Drug Enforcement Administration, and 10 NYCRR Part 80. Prescriptions for controlled substances are accepted, filled, or refused in the professional judgment of a licensed pharmacist and in accordance with applicable law.

7. Adverse Events, Dispensing Errors, and Complaints
7.1 Report an Adverse Drug Event
Patients or caregivers who experience an adverse drug reaction or suspected medication-related adverse event are encouraged to:
- Contact New York City Pharmacy directly at 212-253-8686 to speak with a licensed pharmacist;
- Report the event to the U.S. Food and Drug Administration's MedWatch program at https://www.fda.gov/safety/medwatch-fda-safety-information-and-adverse-event-reporting-program or 1-800-FDA-1088;
- Seek immediate medical attention if the event is serious or life-threatening, or call 911.
7.2 Report a Dispensing Error
If you believe New York City Pharmacy has made a dispensing error (wrong medication, wrong dose, wrong patient, wrong directions), please contact the pharmacy immediately at 212-253-8686 so that a licensed pharmacist can review the prescription and take appropriate action.
7.3 Professional Complaints

10. State Privacy Rights Supplement
This section supplements our Privacy Policy with additional disclosures required by certain U.S. state privacy laws. It applies only to residents of the states referenced below. Your core privacy rights, the categories of personal information we collect, and our uses and disclosures of personal information are described in full in our Privacy Policy.
10.1 California Residents — CCPA / CPRA
If you are a California resident, the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act (collectively, the "CCPA") provides you with specific rights regarding your personal information.
Categories of personal information collected. In the preceding 12 months, we have collected the following categories of personal information, as defined by the CCPA: identifiers (name, address, email, phone, IP address); customer records information; commercial information (transactions and products purchased); internet or network activity; geolocation data (approximate, from IP address); and inferences drawn from the foregoing. For patients of our licensed pharmacy services, we also collect medical and health insurance information, which is governed primarily by HIPAA as described in our Privacy Policy.
Sources. We collect personal information directly from you, automatically from your use of the Services, from our service providers (including Shopify), and from our business partners.
Business purposes. We use personal information for the purposes described in our Privacy Policy, including providing and improving the Services, fulfilling orders, processing payments, communicating with you, marketing, security and fraud prevention, and compliance with law.
Disclosure and "sale" / "sharing" of personal information. We disclose personal information for business purposes to our service providers (including Shopify) as described in our Privacy Policy. For purposes of the CCPA, we do not knowingly "sell" personal information in exchange for money. Our use of certain Shopify enhanced advertising features may be considered "sharing" of personal information for purposes of cross-context behavioral advertising under the CCPA. You have the right to opt out of such sharing through the mechanisms described in our Privacy Policy.
Your California rights:
- Right to Know what personal information we have collected about you;
- Right to Delete personal information we maintain about you (subject to exceptions);
- Right to Correct inaccurate personal information;
- Right to Opt Out of the "sale" or "sharing" of your personal information;
- Right to Limit Use and Disclosure of sensitive personal information;
- Right to Non-Discrimination for exercising your CCPA rights.
Protected Health Information is excluded. Protected Health Information collected and maintained by New York City Pharmacy as a HIPAA-covered entity is governed by HIPAA and is not subject to the CCPA, consistent with Cal. Civ. Code § 1798.145(c)(1).

10.2 Residents of Virginia, Colorado, Connecticut, Utah, and Other States with Comprehensive Privacy Laws
Residents of other U.S. states that have enacted comprehensive consumer privacy laws may have similar rights with respect to their personal information, including rights to access, correct, delete, and opt out of targeted advertising, the "sale" of personal information, and certain profiling. To exercise those rights, contact us at Hello@nycprx.com. As with California, Protected Health Information regulated by HIPAA is generally excluded from the scope of these state privacy laws.
10.3 Shine the Light (California)
